Luis Diaz Vs Topps Over Garbage Pail Kids Court Case: The Latest
Last year, Bleeding Cool ran a story about Topps suing the artist Luis Diaz over his parody of their Garbage Pail Kids sticker line – itself a parody of the Cabbage Patch Dolls.
Luis Diaz was able to recreate the original Garbage Pail Kids style for Topps and IDW for a revived sticker line and a comic book line. Feeling restrained by issues of taste, and emboldened by officials turning a blind eye to his Garbage Parody Kids CD cover he had created, he created a line of Gavage Parody Kids images to sell to his fans on his website.
And Topps, once itself the victim of a lawsuit by the creators of Cabbage Patch Dolls, sued Luis Diaz.

Earlier this year, Luis Diaz countersued, pointing out that a number of the new images that Topps were using on Garbage Pail Kids new series bore a resemblance to images that were created by him but never sold to Topps. And he included them on his counter suit…
Topps tried to dismiss Luis Diaz' counter claims earlier this month, but the court denied their motion.
Stating, regarding his Batman image (which is probably the strongest image he has) this summary of their decision. Is it just me or is this case going to be studied in law classes to come?
The case being held in Illinois continues.
