As superheros are exposed to specific perils of death basically all the time, and would not generally be suspected to be dead in the absence of such a peril, it seems likely that a court, or at least a genre blind one, would be willing to rule on a superhero's death pretty quickly. Which makes things a bit complicated if they aren't actually dead.

The 2011 Eisner Awards: Judges Named for 2011 Eisner Awards
Comic-Con International (Comic-Con) is proud to announce that the judging panel has been named for the 2011 Will Eisner Comic Industry Awards. This blue-ribbon committee will select the nominations to appear on the Eisner Awards ballot.
This year's judges are: Ned Cato, Jr, Karen Green, Andrew Helfer, Rich Johnson (not not our Rich, the Beat's Rich and Chris Powell.

When I found out who it was that has been killed, I actually felt like I was punched in the gut. I'm not even exaggerating, I still feel the actual pain of loss. Even tho I've not yet received my copy of Issue #39, I couldn't help but find out which character has been killed.
